Terms of Service

ACKNOWLEDGEMENT

CheckDulu is a digital screening platform developed and operated by IGO Smart PLT ("IGO SMART"). By accessing or using CheckDulu or any services provided by IGO SMART, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service ("Terms"). If you do not accept these Terms, please immediately cease any further use of CheckDulu or IGO SMART’s product.

IGO SMART reserves the right to amend, vary, or update these Terms at its sole discretion at any time. Notifications of such changes may be communicated through the IGO SMART website, email, or any other communication methods deemed appropriate. Unless specified otherwise, such amendments shall take effect immediately upon publication. It is your responsibility to review these Terms periodically. Continuous use of the CheckDulu service after such changes constitutes your acceptance of the revised Terms. Any person you permit to access the Service using your account shall also be bound by these Terms.

1.0 DEFINITIONS

In these Terms, unless the context otherwise requires:

·       "Account" means an account created and registered with CheckDulu by the User for access to the Service.

·       "IGO SMART" means IGO Smart PLT. (Company Registration No. 202204000352) and includes its affiliates, employees, agents, and representatives.

·       "CheckDulu" or "Platform" refers to the digital screening system developed and operated by IGO SMART.

·       "Content" refers to any materials, data, text, audio, video, graphics, software, or other information made available through the Platform.

·       "Parties" means both you (the User) and IGO SMART collectively.

·       "Service" refers to all products, data access, and functionalities offered via the CheckDulu platform including, but not limited to, individual or business background screenings, verification reports, and analytical tools.

·       "Terms" or “Terms of Service” means these legally binding terms and conditions and any applicable policies, guidelines, or amendments issued by IGO SMART.

·       "User", "You", or "Your" means the person or entity using or accessing the CheckDulu Service, including sole proprietors, partnerships, companies, institutions, and governmental bodies.

2.0 DESCRIPTION OF SERVICE

You agree to use the CheckDulu service solely for lawful and authorized purposes. You are solely responsible for all activity conducted under your Account. Your use of the Service is conditional upon your compliance with these Terms and all applicable laws and regulations. You are responsible for ensuring that all data you provide is accurate, complete, and up-to-date.

Certain features of the Service may require additional registration or incur fees. You must provide all necessary hardware, software, and internet access to use the Service. IGO SMART may, without prior notice, introduce new features or modify, suspend, or discontinue any aspect of the Service. All enhancements shall be subject to these Terms.

3.0 INTELLECTUAL PROPERTY AND CONTENT USAGE

All intellectual property rights, including trademarks, copyrights, trade names, logos, and proprietary data made available through CheckDulu, belong exclusively to IGO SMART or its licensors. You may view and use the Content for personal or internal business use only.

Except with prior written consent from IGO SMART, you shall not:

·       Reproduce, distribute, or republish any part of the Content or Platform;

·       Store or transmit the Content on any public or third-party system;

·       Use any spidering, scraping, or data mining tools on the Platform;

·       Frame or mirror any part of the Platform on another site;

·       Use the Service to build a competing or derivative product.

Any unauthorized use of the Service or Content may result in termination of your Account and legal action.

4.0 WARRANTIES AND LIMITATION OF LIABILITY

All data and services are provided as is, without any warranty or guarantee of any kind. We and the data owners expressly disclaim all warranties, whether express or implied, including but not limited to any representations, warranties, obligations or liabilities in relation to the data or service accuracy, availability, reliability, or fitness for a particular purpose.

We are not responsible for:

·       Interruptions or limitations to the service caused by User(s) or third-party system capacity issues, maintenance, updates, suspected fraud, abuse, viruses, or other misuse of the internet network;

·       Any data loss, inability to retrieve data, or service outages caused by or arising from actions or omissions of User(s) or third parties;

·       Any incidental, punitive, consequential, or indirect damages arising from service issues, including loss, alteration, destruction, or unauthorized disclosure of any data, regardless of cause;

·       The accuracy, completeness, legality, reliability, or operability of data provided by IGO SMART

We do not guarantee:

·       That the service and website will meet your expectations or requirements;

·       That the service will be uninterrupted, timely, secure, or error-free;

·       That the results obtained from the use of the service will be accurate or reliable;

·       That messages or data transmitted via our systems will be delivered successfully or without delay.

Use of the service and any data is at your own risk. No responsibility is assumed for errors, delays, deletions, or data delivery failures under any circumstances.

5.0 FEES, CHARGES, AND PAYMENT TERMS

You agree to pay all applicable fees as stated on the CheckDulu or IGO SMART’s platform for the Services rendered. All fees are subject to applicable taxes including SST or any other tax imposed by law. IGO SMART reserves the right to reject or cancel any transaction if the information provided is inaccurate, outdated, or incomplete. Payment transactions may be affected by network or technical issues beyond IGO SMART’s control. IGO SMART shall not be liable for any transaction failures, delays, or errors caused by such events.

6.0 REFUND POLICY

If you detect an error or discrepancy in any transaction, you must notify IGO SMART in writing within seven (7) days of the transaction date. Upon verification and confirmation of the error, any refund will be processed in accordance with IGO SMART's refund policy available at www.checkdulu.my/refund. Failure to report the issue within the specified period constitutes your acceptance of the transaction as accurate and final.

7.0 SUSPENSION AND TERMINATION

IGO SMART reserves the right to suspend or terminate your access to the Service with immediate effect in the following circumstances:

·       Non-payment of any fees or outstanding dues;

·       Breach of any provision in these Terms;

·       Violation of applicable laws or misuse of the Service;

·       Technical or maintenance-related shutdowns;

·       Fraudulent or unauthorized activity suspected on your Account;

·       Any conduct that may harm IGO SMART's reputation or operations;

·       Pursuant to legal or regulatory requirements.

IGO SMART will endeavour to provide notice where feasible but is not obligated to do so in cases of emergency or breach. Termination does not relieve you from liability for amounts due or breaches incurred before the date of termination.

8.0 GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

9.0 GENERAL

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and IGO SMART in respect of your use of the Service and supersede all prior understandings, communications, and agreements. Failure by IGO SMART to enforce any right or provision shall not constitute a waiver of such right or provision.
